Areas of Practice

  • Personal Injury

We represent individuals involving injuries related to negligence by operators of motor vehicle, property owners and other responsible parties/entities.  Our understating of New Jersey’s automobile, insurance and liability laws means we understand the different sources of recovery available to car accident victims and their families.

We provide comprehensive and compassionate representation aimed at moving your case forward and obtaining fair compensation for your injuries.  In automobile accident matters, we process your medical bills with the responsible Personal Injury Carrier so as to assure their payment within the statutory guidelines.

  • Workers' Compensation

If you are injured while working on your job due to an accident or have been exposed to chemicals or conditions/exposures from a job that has caused your injury or illness, you have certain rights under the law.  You are entitled to:

    • Medical treatment
    • Temporary disability benefits
    • Money awarded to compensate you for permanent loss of body functions that you sustained due to your injuries

At Menz and Luxenberg, we have over twenty six years experience representing people injured on the job, fighting for their rights to receive workers’ compensation benefits, assuring that they are paid at the correct rate and they are paid for the total or partial loss of the use or function of any aspect of their body.

We take special care to address each injured persons individual needs and concerns, whether they sustained an orthopedic/bone injury, neurological/nerve type injury, pulmonary/lung disability, heart attach/illness or scarring/disfigurement type of injury.

  • Residential Real Estate Transactions

Your home typically represents the single largest investment of your lifetime.  When you are considering buying or selling a home why would you not protect your investment with qualified legal advice?  As part of the team that includes your realtor and mortgage representative we work to assure that your legal rights are protected and that you have a complete understanding of the entire process, from initial offer through the closing.  Every client, every property and every transaction is unique and deserves to be treated that way.  We pride ourselves in taking the time to understand the clients’ needs and working diligently to meet those needs and to exceed expectations.  We provide objective guidance and information so that you can make properly informed decisions.  We help you navigate the maze associated with buying and/or selling your home.

  • Commercial and Investment Real Estate

Whether it be negotiating a retail lease or buying/selling a rental/commercial property, the potential issues surrounding such a transaction are virtually limitless.  Having competent, professional representation on your side can be invaluable.

  • Business and Corporate Law

We provide a wide variety of services to business clients including assisting in the sale and purchase of a business, selecting the type of organizational entity under which to operate, such as a Corporation or Limited Liability Company and reviewing/preparing business agreements.
When representing a business client, we actively listen to our client’s business plans and work with them to develop the best legal structure that fits their needs.

  • Municipal Court and Criminal Matters

For most people the Municipal Courts of the State of New Jersey are the closest they come to being personally involved with the justice system.  More cases are processed and more fines are paid in the Municipal Courts than in the higher courts of the state.  The potential ramifications of a conviction in Municipal Court include monetary fines, community service, jail, loss of driving privileges as well as a criminal and/or motor vehicle record.  These ramifications have the potential to impact your livelihood, your insurance rates and your future.  Although you have the constitutional right to represent yourself in the Municipal Courts, given the possible ramifications why would you?

If you are accused of a motor vehicle offense or a disorderly persons offense you need to know your rights as well as your options before you go to court.  Court is not a “do-it-yourself” friendly environment.  You will likely be encountering a professional prosecutor and one or more police officers on “the other side”.  Competent legal counsel can help balance the scales of justice.

At Menz and Luxenberg we zealously defend our clients to assure that justice is done.  Our clients are partners in the process.  Nothing is done without the client being fully informed about the options available to them.  An attorney should be retained to inform you about what you need to know, not to tell you what you’d like to hear.  We have the knowledge and experience to provide you with an informed and objective view of the likely outcomes of your decisions.  Everyone can benefit by having a “Fiend in Court”.  Call Menz and Luxenberg today!!!

  • Wills, Living Wills and Estates

What will happen to your family and your wealth when you pass away?  A properly drafted and executed Will can make a major difference in easing the burdens upon your loved ones at their time of need.  A Will is a document outlining your wishes for the distribution of your property both real and personal at the time of death. One of the ideas behind preparing a will is to prevent survivors from fighting over the assets you worked your entire life to acquire.

We also prepare Living Wills for our clients.  A Living Will involves how you want to be treated medically if you can no longer assist in the decision making process.  This includes naming someone who can act on your behalf to make medical decisions in consultation with your physicians.

To compare, a Living Will is only in effect for as long as you are alive, whereas a Will only becomes effective after you die.

We also represent clients concerning Estates.  An Estate comes in to effect upon someone’s death. In the case of a Will, this consists of filing the Will in the Surrogates’ Court.  Assisting the Executor (or Administrator in situations without a Will) with the gathering of all assets and liabilities, notifying all beneficiaries listed in the Will, settling any and all claims against the Estate, payment of taxes and distributing the assets.

We also assists clients in the preparation and drafting of durable power of attorneys for those clients that need the assistance of other individuals to do things on their behalf, such as banking, selling assets and conducting general business matters.  This is often helpful to those of advancing age who find it difficult to conduct business on their own.

This list is far from exhaustive. We also represent clients in social security disability hearings, landlord-tenant matters, preparing and reviewing residential and corporate leases, juvenile delinquency matters, name changes and other matters. In short, we have the knowledge and experience to represent individuals and business enterprises in those areas of law in which they may need assistance. We welcome the opportunity to speak with you about any legal concerns you may have.
